One Man Band Websites Terms and Conditions 2026

These terms and conditions apply to websites commissioned on or after 3 September 2026 and replace our previous Terms and Conditions 2024.

By ordering our website design service, you agree to the following terms and conditions.

Is this an ongoing service and what is the minimum term?

Yes. This is an ongoing monthly website service rather than a one-off website purchase.

The service has a fixed minimum term of 24 months, beginning on the date your website goes live. This period allows us to recover the time and expense involved in designing, developing and launching your website while offering the service at an affordable monthly price.

After the initial 24-month period, the service will continue on a rolling monthly basis unless cancelled in accordance with these terms.

What does the monthly fee cover?

Our pricing model differs from the large upfront payment normally charged for a new website.

Unless otherwise agreed in writing, the monthly fee includes:

  • The design and development of a WordPress website containing up to 12 pages.
  • Website hosting through a professional hosting provider.
  • Regular updates to WordPress and the software used on the website.
  • Regular updates to website security software.
  • Routine website backups and maintenance.
  • The registration and renewal of one .co.uk domain name.
  • The initial setting up of basic business email addresses through our webmail system.
  • Up to one hour of website changes each month.

The included hour of website changes cannot be carried forward from one month to another.

Work exceeding the included hour will be charged at our standard hourly rate, currently £50 per hour. We will agree any additional charges with you before carrying out the work.

Professional email services provided through Microsoft 365 or Google Workspace are separate services and may be subject to an additional monthly fee.

Can the monthly fee change?

We reserve the right to review and increase our fees annually.

An increase may reflect inflation, supplier price increases, exchange-rate changes, taxation or increases in the cost of providing the service.

We will notify you before any increase takes effect.

Who owns the website text?

Red Flame Marketing Limited, which owns the trading division One Man Band Websites, retains copyright in text created by us for the website.

You retain ownership of text and other content that you supply to us.

While we provide the website service, you have permission to use the text created by us on the website for the purposes of promoting your business.

Can you use the website text elsewhere?

If you wish to use text created by us in brochures, flyers, leaflets or other sales and corporate literature, an additional copyright fee may apply.

Where we provide you with other ongoing marketing services, we may waive this fee as a goodwill gesture. Any permission or waiver should be agreed with us in writing.

Who owns the images?

You retain ownership of images that you supply to us.

Stock images obtained by One Man Band Websites remain subject to the licence terms imposed by the relevant image provider. Those licences may restrict how the images can be used or transferred.

We normally supply up to four stock images per website page. Additional royalty-free images are charged at £20 each unless otherwise agreed.

Where you pay separately for an additional image, we will explain the usage rights included. Payment for an image does not override any restrictions imposed by the original image provider.

Who owns the website design and build?

One Man Band Websites retains copyright in the original website design, layout and build where these have been created by us.

The monthly fee provides you with the right to use the website for your business while we provide the website service.

Following completion of the 24-month minimum term and payment of all amounts due, you may continue to use the website for your own business if you subsequently cancel our service, subject to the cancellation and handover provisions below.

This does not transfer ownership of our underlying copyright or any third-party software, premium themes, plugins, stock images or other separately licensed materials.

Who owns the domain name?

When we register a domain name as part of the website service, it will be registered, renewed and managed by One Man Band Websites while we provide the service.

If our service is cancelled after completion of the minimum term, and all outstanding amounts have been paid, you may request that the domain be transferred to you or another provider.

Following transfer, responsibility for the domain’s renewal, administration, security and associated costs will pass to you.

Any additional work required to complete the transfer may be charged at our standard hourly rate, agreed with you in advance.

What is the minimum term?

The minimum term is 24 months from the date your website goes live.

This is a reasonable period for us to recover the time and expense involved in designing, developing, launching and maintaining your website.

What happens if you cancel during the minimum term?

If you cancel the website service before the end of the initial 24-month minimum term, you will be required to pay an early termination charge.

This will ordinarily be equal to the outstanding monthly fees for the remainder of the minimum term. It reflects the website design and development costs that we expected to recover over the agreed period, less any costs that we reasonably save as a result of the early cancellation.

All outstanding invoices and termination charges must be paid before any website files, domain name or related materials are released.

What happens after the minimum term?

After the initial 24-month minimum term, the service will continue on a rolling monthly basis. You may cancel the service by giving us one month’s written notice.

If you decide to move the website to another provider, and all outstanding amounts have been paid, we will make reasonable arrangements to supply a standard copy of the transferable website files and database and, where applicable, transfer the domain name.

Third-party software, premium themes, plugins, stock images and other licensed materials may not be transferable. A new provider may need to purchase replacement licences or make changes to the website.

The standard handover of available website files is included. Any migration work, technical assistance, troubleshooting or other work requested by you or your new provider will be charged at our standard hourly rate of £50, or another rate agreed with you in advance.

Our hosting, maintenance, security updates, backups and website support will end when the cancellation takes effect. We will not be responsible for the website’s operation once it has left our hosting and management.

What happens to basic webmail if the website service ends?

Basic webmail accounts supplied as part of our website hosting are connected to that hosting service.

These mailboxes will therefore close when the website hosting service ends.

Before cancellation takes effect, you must arrange to:

  • Export and back up your email.
  • Transfer your email to another hosting provider; or
  • Upgrade to a separate Microsoft 365 or Google Workspace service.

You may arrange this yourself, or we can assist at our standard hourly rate of £50. Any charge will be agreed with you in advance.

We are not responsible for email or other data left on the hosting account after the service has ended and any agreed migration period has passed.

What happens to Microsoft 365 or Google Workspace?

Microsoft 365 and Google Workspace are separate professional email services. Cancelling your website service does not automatically cancel a professional email service.

Unless you cancel the professional email service separately, we will continue to supply, administer and invoice you for it at the agreed monthly fee.

The monthly charge may include:

  • The underlying Microsoft 365 or Google Workspace licence.
  • Licence renewal and billing administration.
  • Basic account administration.
  • Reasonable support connected with the email account.

The fee may change to reflect supplier price increases, taxation, exchange-rate changes or changes to the number or type of licences required. We will notify you before an increase takes effect.

A request to cancel or transfer a professional email service must be made separately in writing. Unless otherwise agreed, one month’s notice is required.

Any cancellation or transfer will be subject to the supplier’s rules and any existing monthly or annual subscription commitment. You will remain responsible for charges that cannot be cancelled or refunded during an existing commitment period.

We will provide reasonable assistance with an account handover once all outstanding amounts have been paid. Additional migration, troubleshooting or technical work may be charged at our standard hourly rate of £50, agreed with you in advance.

Who is this website service available to?

This service is intended for sole traders, start-ups and small existing businesses with an annual turnover of up to £100,000.

Different fees may apply to businesses with an annual turnover exceeding £100,000. Please ask us for a bespoke quotation.

Website changes and additional work

Once the website is live, the monthly service includes up to one hour of website changes each month.

Work exceeding the included hour is charged at our standard hourly rate of £50. We will agree the likely cost with you before carrying out additional work.

Substantial changes, additional pages, new functionality, ecommerce facilities or a significant redesign may be quoted separately.

Information supplied by you

You are responsible for ensuring that information, text, images and other materials supplied to us are accurate and that you have permission to use them.

You must notify us if information on the website needs to be corrected or updated.

We are not responsible for claims arising from inaccurate, unlawful or unauthorised material supplied by you.

Website availability and security

We will take reasonable steps to maintain the website, keep its software updated and protect it against common security threats.

However, no website, hosting platform or online service can be guaranteed to operate continuously or be completely secure.

We are not responsible for temporary interruptions caused by maintenance, supplier outages, cyberattacks, internet failures or circumstances outside our reasonable control.

Website performance disclaimer

Having a website does not guarantee that you will receive enquiries or generate new business.

Most websites require additional and sustained marketing activity to attract relevant visitors. This may include:

  • Search engine optimisation.
  • Email marketing.
  • Social media marketing.
  • Content creation.
  • Google advertising.
  • Facebook advertising.
  • LinkedIn advertising.
